Risk Disclosure
This Risk Disclosure applies to openmarket.xyz ("OpenMarket", "we", "our", "us"), operated by Thalamus Technologies, Inc., and to everything we publish, including the Platform, this website, our documentation, blog and academy, and our social media accounts. It forms part of our Terms of Service.
1. Trading Involves Substantial Risk of Loss
Trading futures, options on futures, forex, perpetual contracts, stocks, exchange-traded funds, prediction markets and digital assets involves substantial risk of loss and is not suitable for every investor. An investor could lose all of, or more than, the initial investment. Risk capital is money that can be lost without jeopardizing one's financial security or lifestyle; only risk capital should be used for trading, and only those with sufficient risk capital should consider trading.
- Profit and loss are not symmetrical. The possibility of profit is not equal to, or proportional to, the possibility of loss. A small market move can produce a large loss.
- Leverage. Futures and perpetual contracts are leveraged. A small deposit controls a large position, so losses can equal or exceed the funds deposited, and a position can be liquidated or closed out at a loss without further notice.
- Orders may not limit losses. Stop and limit orders may not execute at the price entered, or at all, in fast, illiquid or halted markets.
- Market conditions. Prices can gap, liquidity can disappear, and exchanges or venues can halt trading or change margin requirements at any time.
2. Past Performance
Past performance, whether actual or shown in charts, indicators, backtests or examples, is not indicative of future results. Any reference to a past trade, price move or result is illustrative and makes no representation that any account will or is likely to achieve similar results.
3. Hypothetical Performance
Backtests, strategy tests, paper-account results, trade examples and other simulated results are hypothetical. Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect trading results.
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.
4. Information, Opinions and AI-Generated Content
- Charts, market data, indicators, alerts, analytics, AI-generated content, documentation, blog and academy articles, and social media posts are provided for information and education only.
- Where content expresses a view about a market, price or asset, it is the opinion of its author at the time of publication and is presented as opinion, not as fact or as a recommendation.
- Nothing we publish is investment, trading, tax or legal advice, a recommendation to buy or sell any instrument, or a solicitation to open an account with any brokerage or venue.
- Market data and AI-generated content can be delayed, incomplete or wrong. Verify information independently before acting on it.
- Trade examples, chart walkthroughs and videos, including those we share from other accounts, are for educational purposes only; the opinions expressed are those of the presenter, and all trades presented should be considered hypothetical and not expected to be replicated in a live trading account.
- Testimonials and user comments we publish or share may not be representative of other users and are not a guarantee of future performance or success.
5. Digital Assets
Digital assets and their derivatives are highly volatile and trade on venues that may be lightly regulated. See the CFTC customer advisories, which contain more information on the risks associated with trading virtual currencies.
6. Third-Party Brokerages and Venues
Orders you place through the Platform are executed by the brokerage or venue you connect, under its own terms and risk disclosures, which you should read before trading. We are a software provider; we do not execute, clear or hold your orders, funds or positions.
